All our lawyers are appointed by the Ministry of Justice in Denmark and members of the Danish Bar and Law Society.
Our lawyers are also all covered by the Danish Bar and Law Society’s supervisory and disciplinary system and by the rules of the Danish Administration of Justice Act on good legal practice. Good legal practice is a standard of conduct, which includes rules on professional secrecy, according to which lawyers and employees may not disclose information obtained through their work, and conflicts of interest, according to which the lawyer may not advise a client in the event of a conflict over other interests. All employees are subject to our internal insider rules as well as applicable legislation to prevent insider dealing, which includes a ban on any disclosure of inside information about listed companies and restrictions on trading in listed securities.
PUNCT Advokater has taken out liability insurance for all the office’s lawyers and provided a guarantee in accordance with the rules laid down by the Danish Bar and Law Society. The liability insurance covers all legal activities, including as a mediator, appointed supervisor, liquidator or reconstructor. We manage client funds in accordance with the Danish Bar and Law Society’s rules on this. Therefore, client funds are deposited in separate client accounts at Nordea Bank, unless otherwise agreed. Client funds in client accounts are protected up to EUR 100,000 per client per financial institution under the Investor Guarantee Scheme. The coverage cap includes the client’s deposits in their own accounts, in separate client accounts and in pooled client accounts.
Upon receipt of an assignment, we investigate options for public or insurance-covered legal aid for the client. If our fee is paid provisionally or definitively by the public sector or by an insurance company, we will inform the client of the principles for determining the fee and of the possible consequences for the client.
PUNCT Advokater’s terms and conditions apply to any task that we undertake, unless otherwise agreed in writing.
Any dispute between a client and PUNCT Advokater must be resolved in accordance with Danish law by the Danish courts with the Copenhagen City Court as the court of first instance. In the event of a dispute about fees charged by PUNCT Advokater and/or dissatisfaction with the conduct of one of PUNCT Advokater’s lawyers, the client may complain about the amount of the fee and/or the conduct to the Disciplinary Board of the Danish Bar and Law Society, Kronprinsessegade 28, 1306 Copenhagen K, Denmark.
